he took the stand to describe the incident that he said he saw former penn state coach jerry sandusky sexually assaulting a young boy in the team's locker room. mcqueary said he saw sandusky standing behind the child with his hands around the child's waist. the boy according to mcqueary appeared to be 10 or 12 years old and not 100% sure if it was intercourse, but the way they were positioned was very sexual in nature. mcqueary said he reported what he saw without giving details, but he did not go to police. a written statement is expected to be read in the courtroom later this afternoon. michelle franzen joins me from harrisburg, pennsylvania. we know in the past, he sent a note to his friends in an e-mail saying he tried to stop this alleged assault in court. he explained the way he tried to stop it was by slamming a locker. >> yeah, well he said that he made contact and tried to make eye contact with them about three different times. he told prosecutors that he was certain that both san dusky and the boy he said was in the shower room at the time saw him and separated at that time.

joining me now is jerry sandusky's defense counsel carl rominger. almost unprecedented certainly in pennsylvania. the big question everyone is asking, why did you waive jerry sandusky's rights to have this hearing today? >> unprecedented in large cases, normal in almost everyday cases, i have to point that out. but the biggest issue here was what we got in exchange for the waiver. what we got was an assurance that the bail would not be moved no matter what happens. so basically the commonwealth gave up their ability to raise the bail even if they bring new charges. we don't believe there's anything in the pike right now. but they had hinted that was a possibility. they also conceded to give us discovery early. in pennsylvania we get no discovery at the time of the preliminary hearing. other states you get discovery at this stage. that was important to begin digesting it. >> the key thing about pennsylvania's process, which is seen as advantageous to a defense team is you get to see potential witnesses against you and you get to examine them, see how

jerry sandusky remains behind bars this morning follow new child sexual abuse charges. his gail set at $225,000. the latest charges based on the testimony of two new alleged victims. >> 67-year-old jerry sandusky was led away from his home wearing handcuffs wearing a penn state track suit and slapped with 12 new charges on wednesday from two new accusers. >> if this is the way the case is going to be handled by the other side, then we can do things to kind of make it miserable too. >> reporter: sandusky was first charged on november 5th. he has acknowledged showering and playing around with boys, but says he never sexually abused them. he now faces more than 50 counts including abuse that is alleged to have occurred on the penn state campus. sandusky is behind bars here in bellfont, pennsylvania. the new accusers told accusers they met sandusky through the second mile charity. he testified that at least once, he screamed for help, knowing that sandusky's wife was upstairs, but no one ever came to help him. if sandusky does make bail, he'll be under house arrest and subj
